TERMS, CONDITIONS AND LIABILITY CLAUSE<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

INCONTEXT DMC<\/strong>, a brand of PAIDEIA DESTINOS Y CULTURA S.A.S.<\/strong>, registered under the Colombian National Tourism Registry (RNT No. 69926<\/strong>) issued by the Ministry of Commerce, Industry and Tourism of Colombia, is responsible for the proper provision and quality of the tourism services described in its programs, in accordance with Law 300 of 1996, Law 1480 of 2011, Regulatory Decree 1074 of 2015, and any regulations that amend, supplement, or replace them.<\/p>

Rates, programs, itineraries, and services offered are subject to availability, validity, and modification without prior notice by suppliers or due to operational circumstances beyond the control of INCONTEXT DMC.<\/p>

Products and services quoted or purchased in foreign currencies will be settled using the official exchange rate (TRM \u2013 Market Representative Exchange Rate) in effect on the date of payment.<\/p>

RIGHT OF WITHDRAWAL<\/strong><\/p>

In accordance with Article 47 of Law 1480 of 2011 and other applicable regulations, customers may exercise their right of withdrawal when a purchase has been made through non-traditional or remote sales channels, within the terms and conditions established by law.<\/p>

In cases where withdrawal applies, INCONTEXT DMC will process the refund request with the corresponding suppliers, subject to the conditions, restrictions, administrative fees, and penalties established by such suppliers and applicable regulations.<\/p>

When the provision of tourism services has already begun or is scheduled to begin within the legal period established for exercising the right of withdrawal, this right may not apply in accordance with the exceptions provided under Colombian law.<\/p>

IMPORTANT INFORMATION FOR TRAVELERS<\/strong><\/p>

Availability of hotels, ground transportation, activities, flights, experiences, and other services will only be confirmed once payment has been received and the reservation has been accepted by the corresponding suppliers.<\/p>

Quotations issued by INCONTEXT DMC reflect availability and rates valid at the time of issuance and do not constitute a guarantee of future availability or rate maintenance.<\/p>

Quoted rates will only be honored upon confirmation of the reservation and receipt of the corresponding payment.<\/p>

PERSONAL DATA PROTECTION<\/strong><\/p>

In compliance with Law 1581 of 2012, Decree 1377 of 2013, and related regulations, PAIDEIA DESTINOS Y CULTURA S.A.S.<\/strong>, through its brand INCONTEXT DMC<\/strong>, acts as the data controller for personal information provided by clients, users, suppliers, and business partners.<\/p>

The information provided may be used for the following purposes:<\/p>

  • Managing reservations and tourism services.<\/li>
  • Fulfilling contractual and legal obligations.<\/li>
  • Sending information regarding products and services.<\/li>
  • Monitoring and evaluating service quality.<\/li>
  • Responding to requests from competent authorities.<\/li><\/ul>

    Personal data will be processed in accordance with the Personal Data Processing Policy of PAIDEIA DESTINOS Y CULTURA S.A.S.<\/p>

    GENERAL CONDITIONS<\/strong><\/p>

    Confirmation of any reservation implies full acceptance of these general terms and conditions, payment policies, cancellation policies, and all requirements applicable to the contracted services.<\/p>

    All travelers must carry valid identification documents, visas, immigration permits, vaccination certificates, and any other documents required by the relevant authorities.<\/p>

    Each traveler is responsible for safeguarding their personal belongings, luggage, documents, and valuables throughout the trip.<\/p>

    Travelers are expected to maintain respectful, lawful, and appropriate conduct during the provision of services.<\/p>

    INCONTEXT DMC reserves the right to remove from any activity or program any participant whose conduct affects the safety, integrity, or proper execution of the travel experience, without obligation of refund.<\/p>

    ITINERARY MODIFICATIONS<\/strong><\/p>

    INCONTEXT DMC reserves the right to modify itineraries, schedules, routes, means of transportation, activities, or substitute accommodations with others of similar or higher category whenever operational, weather-related, security, force majeure, or other circumstances beyond its control so require.<\/p>

    Such modifications will be made while seeking to preserve the quality and nature of the contracted experience.<\/p>

    LIABILITY<\/strong><\/p>

    INCONTEXT DMC acts as an intermediary between travelers and various tourism service providers, including hotels, airlines, local operators, transportation companies, restaurants, museums, natural parks, and other suppliers involved in the execution of travel programs.<\/p>

    Accordingly, INCONTEXT DMC shall not be held liable for delays, cancellations, accidents, road closures, adverse weather conditions, strikes, demonstrations, civil disturbances, governmental actions, epidemics, pandemics, natural disasters, governmental restrictions, or any other event of force majeure or unforeseen circumstance affecting the provision of services.<\/p>

    In the event that a traveler voluntarily interrupts a trip, no refund shall be provided for unused services unless otherwise specified by the corresponding supplier.<\/p>

    PAYMENT POLICY<\/strong><\/p>

    Payment terms will be specified in each proposal, quotation, or service agreement.<\/p>

    Unless otherwise agreed:<\/p>

    • A deposit may be required to confirm the reservation.<\/li>
    • The remaining balance must be paid prior to the commencement of services.<\/li>
    • Last-minute reservations may require immediate payment.<\/li><\/ul>

      Failure to make payment within the specified deadlines may result in automatic cancellation of the reservation.<\/p>

      CHANGE AND CANCELLATION POLICIES<\/strong><\/p>

      Cancellation and modification policies are subject to the conditions established by hotels, airlines, tour operators, and other suppliers involved in each program.<\/p>

      Depending on the cancellation date, penalties, administrative fees, and non-refundable charges may apply.<\/p>

      Specific conditions will be detailed in each quotation or travel proposal.<\/p>

      Unused services after the commencement of the trip are non-refundable unless expressly authorized by the corresponding supplier.<\/p>

      REFUNDS<\/strong><\/p>

      Authorized refunds will be subject to:<\/p>

      • The specific conditions of each supplier.<\/li>
      • Banking and administrative processing times.<\/li>
      • Applicable deductions for financial charges, administrative fees, or penalties.<\/li><\/ul>

        Once approved, refunds will be processed within the timeframes established by applicable legislation and supplier policies.<\/p>

        TRAVELER RECOMMENDATIONS<\/strong><\/p>

        Travelers are strongly advised to obtain travel insurance, medical assistance coverage, and protection against trip cancellation, baggage loss, and travel emergencies.<\/p>

        Travelers should also verify, in advance, all immigration, health, and entry requirements applicable to their destination.<\/p>

        \n\t\t\t\t\t\t\t\t\t

        INCONTEXT DMC<\/strong>, marca de PAIDEIA DESTINOS Y CULTURA S.A.S.<\/strong>, identificada con Registro Nacional de Turismo RNT No. 69926<\/strong>, expedido por el Ministerio de Comercio, Industria y Turismo de Colombia, es responsable de la adecuada prestaci\u00f3n y calidad de los servicios tur\u00edsticos descritos en sus programas, de conformidad con la Ley 300 de 1996, la Ley 1480 de 2011, el Decreto \u00danico Reglamentario 1074 de 2015 y dem\u00e1s normas que las modifiquen, adicionen o sustituyan.<\/p>

        Las tarifas, programas, itinerarios y servicios ofrecidos est\u00e1n sujetos a disponibilidad, vigencia y modificaciones sin previo aviso por parte de los proveedores o por circunstancias operativas ajenas a la voluntad de INCONTEXT DMC.<\/p>

        Los productos y servicios cotizados o adquiridos en moneda extranjera ser\u00e1n liquidados con la Tasa Representativa del Mercado (TRM) vigente al momento de realizar el pago.<\/p>

        DERECHO DE RETRACTO<\/strong><\/p>

        De conformidad con el art\u00edculo 47 de la Ley 1480 de 2011 y dem\u00e1s disposiciones aplicables, el usuario podr\u00e1 ejercer el derecho de retracto cuando la compra haya sido realizada mediante mecanismos no tradicionales o a distancia, dentro de los t\u00e9rminos y condiciones establecidos por la ley.<\/p>

        En los casos en que proceda el retracto, INCONTEXT DMC gestionar\u00e1 la solicitud de reembolso ante los respectivos proveedores, aplicando las condiciones, restricciones, gastos administrativos y penalidades establecidas por estos y por la normativa vigente.<\/p>

        Cuando la prestaci\u00f3n del servicio tur\u00edstico haya iniciado o deba iniciar dentro del plazo legal establecido para ejercer el retracto, este derecho podr\u00e1 no ser aplicable de acuerdo con las excepciones contempladas en la legislaci\u00f3n colombiana.<\/p>

        \u00a0<\/p>

        INFORMACI\u00d3N IMPORTANTE PARA EL VIAJERO<\/strong><\/p>

        La disponibilidad de hoteles, transporte terrestre, actividades, vuelos, experiencias y dem\u00e1s servicios solo quedar\u00e1 confirmada una vez se haya recibido el pago correspondiente y la reserva haya sido aceptada por los respectivos proveedores.<\/p>

        Las cotizaciones emitidas por INCONTEXT DMC reflejan disponibilidad y tarifas vigentes al momento de su elaboraci\u00f3n y no constituyen garant\u00eda de disponibilidad futura ni de mantenimiento de tarifas.<\/p>

        Los precios vigentes ser\u00e1n respetados \u00fanicamente al momento de la confirmaci\u00f3n de la reserva y recepci\u00f3n del pago correspondiente.<\/p>

        \u00a0<\/p>

        PROTECCI\u00d3N DE DATOS PERSONALES<\/strong><\/p>

        En cumplimiento de la Ley 1581 de 2012, el Decreto 1377 de 2013 y dem\u00e1s normas concordantes, PAIDEIA DESTINOS Y CULTURA S.A.S., a trav\u00e9s de su marca INCONTEXT DMC, actuar\u00e1 como responsable del tratamiento de los datos personales suministrados por clientes, usuarios, proveedores y aliados comerciales.<\/p>

        La informaci\u00f3n suministrada podr\u00e1 ser utilizada para:<\/p>

        • Gestionar reservas y servicios tur\u00edsticos.<\/li>
        • Cumplir obligaciones contractuales y legales.<\/li>
        • Enviar informaci\u00f3n comercial relacionada con productos y servicios.<\/li>
        • Realizar seguimiento a la calidad de los servicios prestados.<\/li>
        • Atender requerimientos de autoridades competentes.<\/li><\/ul>

          El tratamiento de la informaci\u00f3n se realizar\u00e1 conforme a la Pol\u00edtica de Tratamiento de Datos Personales de PAIDEIA DESTINOS Y CULTURA S.A.S.<\/p>

          CONDICIONES GENERALES<\/strong><\/p>

          La confirmaci\u00f3n de cualquier reserva implica la aceptaci\u00f3n integral de las condiciones generales, pol\u00edticas de pago, cancelaci\u00f3n y dem\u00e1s requisitos aplicables al servicio contratado.<\/p>

          Todos los viajeros deber\u00e1n portar documentos de identificaci\u00f3n, visas, permisos migratorios, certificados de vacunaci\u00f3n y dem\u00e1s requisitos exigidos por las autoridades competentes.<\/p>

          Cada pasajero ser\u00e1 responsable de la custodia de sus pertenencias personales, equipaje, documentos y objetos de valor durante el viaje.<\/p>

          Los viajeros deber\u00e1n observar comportamientos respetuosos, legales y adecuados durante la prestaci\u00f3n de los servicios contratados.<\/p>

          INCONTEXT DMC se reserva el derecho de retirar de cualquier actividad o programa a las personas cuya conducta afecte la seguridad, integridad o adecuada ejecuci\u00f3n de la experiencia tur\u00edstica, sin que ello genere obligaci\u00f3n de reembolso.<\/p>

          MODIFICACIONES DE ITINERARIO<\/strong><\/p>

          INCONTEXT DMC podr\u00e1 modificar itinerarios, horarios, rutas, medios de transporte, actividades o sustituir establecimientos hoteleros por otros de categor\u00eda similar o superior cuando razones operativas, clim\u00e1ticas, de seguridad, fuerza mayor o circunstancias ajenas a su control as\u00ed lo requieran.<\/p>

          Estas modificaciones se realizar\u00e1n procurando mantener la calidad y naturaleza de la experiencia contratada.<\/p>

          \u00a0<\/p>

          RESPONSABILIDAD<\/strong><\/p>

          INCONTEXT DMC act\u00faa como intermediario entre el pasajero y los diferentes proveedores de servicios tur\u00edsticos, incluyendo hoteles, aerol\u00edneas, operadores locales, transportadores, restaurantes, museos, parques naturales y dem\u00e1s prestadores vinculados a la ejecuci\u00f3n de los programas.<\/p>

          Por consiguiente, no ser\u00e1 responsable por retrasos, cancelaciones, accidentes, cierres de v\u00edas, condiciones clim\u00e1ticas adversas, huelgas, manifestaciones, disturbios, actos de autoridad, epidemias, pandemias, desastres naturales, restricciones gubernamentales o cualquier otro evento de fuerza mayor o caso fortuito que afecte la prestaci\u00f3n de los servicios.<\/p>

          En caso de interrupci\u00f3n voluntaria del viaje por parte del pasajero, no habr\u00e1 lugar a reembolso de los servicios no utilizados, salvo que las condiciones particulares del proveedor dispongan lo contrario.<\/p>

          \u00a0<\/p>

          POL\u00cdTICA DE PAGOS<\/strong><\/p>

          Las condiciones de pago ser\u00e1n especificadas en cada propuesta comercial, cotizaci\u00f3n o contrato.<\/p>

          Salvo acuerdo diferente:<\/p>

          • La reserva podr\u00e1 requerir un dep\u00f3sito inicial para su confirmaci\u00f3n.<\/li>
          • El saldo deber\u00e1 ser cancelado antes del inicio de los servicios.<\/li>
          • Las reservas de \u00faltima hora podr\u00e1n requerir pago inmediato.<\/li><\/ul>

            La falta de pago dentro de los plazos establecidos podr\u00e1 generar la cancelaci\u00f3n autom\u00e1tica de la reserva.<\/p>

            \u00a0<\/p>

            POL\u00cdTICAS DE CAMBIOS Y CANCELACIONES<\/strong><\/p>

            Las pol\u00edticas de cancelaci\u00f3n y modificaci\u00f3n estar\u00e1n sujetas a las condiciones establecidas por los hoteles, aerol\u00edneas, operadores y dem\u00e1s proveedores involucrados en cada programa.<\/p>

            Dependiendo de la fecha de cancelaci\u00f3n, podr\u00e1n aplicarse penalidades, gastos administrativos y costos no reembolsables.<\/p>

            Las condiciones espec\u00edficas ser\u00e1n informadas en cada cotizaci\u00f3n o propuesta de viaje.<\/p>

            Los servicios no utilizados una vez iniciado el viaje no ser\u00e1n reembolsables, salvo disposici\u00f3n expresa del proveedor correspondiente.<\/p>

            \u00a0<\/p>

            REEMBOLSOS<\/strong><\/p>

            Los reembolsos autorizados estar\u00e1n sujetos a:<\/p>

            • Las condiciones particulares de cada proveedor.<\/li>
            • Los tiempos de procesamiento bancario y administrativo.<\/li>
            • Los descuentos por gastos financieros, administrativos o penalidades aplicables.<\/li><\/ul>

              Una vez aprobados, los reembolsos ser\u00e1n procesados dentro de los plazos establecidos por la legislaci\u00f3n vigente y las pol\u00edticas de los proveedores.<\/p>

              \u00a0<\/p>

              RECOMENDACIONES AL VIAJERO<\/strong><\/p>

              Se recomienda contar con seguro de viaje, asistencia m\u00e9dica y cobertura para cancelaciones, p\u00e9rdida de equipaje o emergencias durante el viaje.<\/p>

              Asimismo, se recomienda verificar con anticipaci\u00f3n los requisitos migratorios, sanitarios y de ingreso al destino correspondiente.<\/p>

              PAIDEIA DESTINOS Y CULTURA S.A.S., a trav\u00e9s de su marca INCONTEXT DMC<\/strong>, promueve un turismo responsable, sostenible y respetuoso con las comunidades anfitrionas, el patrimonio cultural y el medio ambiente.<\/p>

              La empresa rechaza cualquier forma de explotaci\u00f3n, discriminaci\u00f3n o vulneraci\u00f3n de derechos humanos en el desarrollo de sus actividades.<\/p>
